The name, surname, delivery address, phone and e-mail details provided at the time of ordering apply. These details appear in the order confirmation e-mail and form an integral part of this agreement.
Article 2 - Subject
The subject of this agreement is the determination of the rights and obligations of the parties, in accordance with the provisions of Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, in relation to the sale and delivery of the product ordered by the BUYER from the online store at meshstick.com, the features and sale price of which are stated below and in the Preliminary Information Form.
Article 3 - Product subject to the agreement
The type, quantity, brand/model, sale price, payment method and delivery details of the product are as set out in the order summary and the order confirmation e-mail. Prices listed and announced on the site are sale prices. Announced prices and promises remain valid until they are updated or changed. Prices announced for a limited period are valid until the end of the stated period.
The shipping fee is shown separately in the order summary and is borne by the BUYER; this fee is not charged on orders to which a free shipping campaign applies.
Article 4 - General provisions
4.1. The BUYER acknowledges, declares and undertakes that they have read and are informed of the basic features, sale price and payment method of the product subject to the agreement and the preliminary information on delivery at meshstick.com, and that they have given the necessary confirmation electronically.
4.2. If the product subject to the agreement is to be delivered to a person other than the BUYER, the SELLER cannot be held responsible if the person to whom delivery is to be made does not accept the delivery.
4.3. The product subject to the agreement is delivered to the BUYER or to the person at the address the BUYER has indicated, within the period stated in the Preliminary Information Form depending on the distance of the BUYER's place of residence, provided that the statutory 30-day period is not exceeded.
4.4. The SELLER is obliged to deliver the product subject to the agreement intact, complete and in conformity with the features stated in the order.
4.5. For delivery of the product subject to the agreement, it is a condition that this agreement has been confirmed electronically and that the sale price has been paid by the payment method preferred by the BUYER. If the price of the product is not paid for any reason or is cancelled in the bank records, the SELLER is deemed released from the obligation to deliver the product.
4.6. If, after delivery of the product, the bank or financial institution concerned does not pay the price of the product to the SELLER because the BUYER's credit card has been used unjustly or unlawfully by unauthorized persons in a manner not attributable to the BUYER's fault, the BUYER is obliged to send the product delivered to them back to the SELLER within 3 days. In this case, the shipping costs are borne by the BUYER.
4.7. If it becomes impossible to supply the product ordered, the SELLER shall notify the BUYER in writing within 3 days of the date on which it becomes aware of this, and shall refund all payments collected within 14 days at the latest from the date of notification. If the product cannot be delivered on time due to force majeure or extraordinary circumstances preventing transport, the SELLER likewise notifies the BUYER; the BUYER may request cancellation of the order and, in the event of cancellation, the amount paid is refunded within 14 days.
4.8. Before the performance period under the agreement expires, the SELLER may supply a different product of equal quality and price, provided that it informs the BUYER and obtains the BUYER's express consent. If the BUYER does not consent, the order is cancelled and the payment is refunded within 14 days.
4.9. If the holder of the payment card used for the order is not the same person as the BUYER, or if a security suspicion concerning the card arises before the product is delivered, the SELLER may request the identity and contact details of the cardholder or a bank letter showing that the card belongs to the BUYER. The order is held until this information is provided; if the request is not met within a reasonable time, the SELLER may cancel the order and refund the payment.
4.10. Our products are food items. The BUYER is obliged to store the product received in accordance with the storage conditions stated on its packaging.
Article 5 - Right of withdrawal
The BUYER has the right to withdraw from the agreement within 14 (fourteen) days from the date on which they receive the product subject to the agreement, without giving any reason and without paying any penalty. To exercise the right of withdrawal, it is sufficient to give written notice to the SELLER within this period.
If the right of withdrawal is exercised, the BUYER is obliged to return the product within 10 days of the withdrawal notice to the address Arabacıalanı Mah. 588. Sok. No: 4/12, Serdivan / Sakarya, Türkiye. Since the Preliminary Information Form does not name a contracted carrier, the return shipping cost is borne by the SELLER. Within 14 days of the withdrawal notice reaching it, the SELLER refunds all payments collected, including delivery costs.
Details concerning the cases in which the right of withdrawal cannot be exercised, the conditions for exercising it and the return process are set out in our Returns and Right of Withdrawal policy, which forms an integral part of this agreement.
Article 6 - Products for which the right of withdrawal cannot be exercised
Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for goods that are liable to deteriorate rapidly or whose expiry date may pass, nor for goods whose protective elements such as packaging, tape, seal or wrapping have been opened after delivery and whose return is not suitable for health and hygiene reasons. Tea and coffee products whose packaging has been opened fall within this scope.
Article 7 - Default
Where the BUYER pays by credit card, the consequences of the BUYER's default on the card debt are governed by the credit card agreement between the BUYER and the issuing bank.
Article 8 - Competent authority in case of dispute
For disputes arising from this agreement, within the monetary limits announced by the Ministry of Trade, the Consumer Arbitration Committees and Consumer Courts at the place where the BUYER purchased the goods or services or where the BUYER resides are competent.
Article 9 - Entry into force
The BUYER is deemed to have accepted all the terms of this agreement when they make the payment for the order placed through the site. The SELLER is obliged to ensure that this agreement has been read and accepted by the BUYER on the site before the order is placed.
